WOHVA needs your help!

We have been hard at work representing your interests in Olympia. As a direct result, an amendment to SB5622 (http://apps.leg.wa.gov/billinfo/summary.aspx?bill=5622) will be brought up in the Senate Ways and Means Committee very soon. Please ask the committee members to exempt ORV's from the Discovery Pass!

As passed out of the Senate Natural Resources Committee, the new fees would be applicable to vehicles with offroad vehicle permits even though that was not the intent.
In an attempt to address that issue PSSB5622 added language that exempted vehicles exempt from registration per RCW46.16A.080. Unfortunately, this only provided relief to ORV riders when traveling on roads and left them required to purchase the new access pass for every ORV used off road on State managed public land.

Will you help correct this technical mistake?

Offroad vehicles should be exempt from this new fee legislation because they already pay their access fees via the ORV gas tax and ORV use permits.

This is the only trail based recreation in the state that is completely self funded and now, as this bill currently reads, these same citizens will be required to pay more to support other forms of recreation.

Dirk can you explain in section 8 of RCW 46.16A.080 (http://apps.leg.wa.gov/rcw/default.aspx?cite=46.16A.080) and extension 46.09.450 (http://apps.leg.wa.gov/rcw/default.aspx?cite=46.09.450) where it doesn’t clearly explain bikes, quads and 4x4 without a plate and have an ORV tab are exempt

46.16A.080 does not exempt ORV or trailers.
That is why I worked with Senate Committee staff to get this added:



“Motor vehicle” has the same meaning as defined in RCW 46.04.320 and which are required to be registered under RCW 46.16A.

We have been through this. Does 46.09.450 do the job for you. This is the confusion. I see that this RCW does exemt ORVs

45.09.450 would probably be fine, but so is the language crafted by committee staff. They wanted snowmobiles, bicycles and trailers to be exempt in addition to ORV.

So on the long search by my recourses, the ONLY thing that will have to buy an access pass that isn't motorized but has wheels is a horse drawn carriage

I know there is a list of government ORVs that also don’t have to have permits also. Along with volunteers that are in an official capacity working for the government in some way

So now I am confused as hell with what you are saying
You have said that every single bike, quad and trailer will have to buy an access pass
Now you are saying that RCW 46.09.450 is OK and exempts all ORVs that are not plated. And that the trail rigs that drive to the trail with a plate will have to buy the access pass. The people that trailer there recreational toy to their destination of pleasure will have to buy an access pass for the vehicle that is parked in the parking lot while they are recreating. The people that trailer there street legal recreational toy to the site will have to buy a pass for each. One for the tow rig and one for the trail rig. That is there choice to trailer there toy to the final destination and for that convenience, they pay extra.
So where is the problem?......... Please explain in more detail

This sounds to me that for the better of ORV, the efforts would be better spent making it easier to dual register your plated recreational device for that you can have a street plate and an ORV tab. This would not only help the ORV community by upping the NOVA ORV fund, but also make a more accurate assessment of how many ORVs are in the state. This would give us a better leverage tool when asking for funds

The language I worked out with the Senate committee staff would exempt everything that do not need a street motor vehicle license.

Currently, If you drive on trails without an ORV permit, you must have valid street plates. Every version of SB5622 has plates = needed the new pass.

The proposed amended version would mean that you could drive on trails with an ORV permit and not need the new pass.

The reason someone that drives on trails with a street plated vehicle would want to dual register as an ORV instead of buying the new pass is because of where the money goes.

With the new pass only 6 percent goes to the DNR and none of that is earmarked to go to motorized use trails.

With the ORV permit all of the money (when the legislature does not steal it) goes to NOVA grants for motorized use only.

There are plenty of circles in Olympia and not everything makes sense down there.
